What is CIL?

A description and overview of CIL

Community Infrastructure Levy (CIL)

The Community Infrastructure Levy is the Government’s chosen approach to set a mandatory tariff on development. It's also known as the CIL or 'the Levy'. It came into force on 6 April 2010 through the Community Infrastructure Levy Regulations 2010.

We formally adopted the Community Infrastructure Levy Charging Schedule at the full Council meeting on 19 January 2017. The examination webpage provides details of the steps taken prior to the full council meeting.

The Charging Schedule came into effect on 15 February 2017. It applies to planning decisions made from that date.

CIL will allow the Council (also known as CIL Charging Authority, or ‘CA’) to raise funds from new development in our area. Our CIL Processes webpages provide a detailed explanation of each stage of the process. We also have a flowchart showing the main requirements of CIL.

The CIL funds received will contribute towards funding improvement to infrastructure (facilities and services). These are required to support the development and growth planned for the borough.

Who does CIL apply to?

CIL applies to development where there is an increase in floorspace.

It's:

  • charged in £ per square metre of gross internal floorspace
  • based on type and location of the development

We charge CIL on:

  • residential development
  • retail supermarket and warehouse developments

For all other development types there is no charge.

Reliefs and exemptions

The regulations provide exemption from CIL in the following circumstances:

The regulations also permit local authorities to provide discretionary charitable relief, exceptional circumstances relief and discretionary social housing relief. But we're currently not proposing to make such relief available. We're committed to keeping this decision under review.

Enforcement

The process and format of the forms is prescribed by the Community Infrastructure Levy Regulations 2010. There are surcharges if these are not strictly followed. 

Monitoring

The CIL regulations require us to report on CIL collection and spend. We'll do this as part of our Annual Monitoring Report. This will show:

  • how much CIL has been collected
  • the total amount that has been spent
  • the degree to which particular projects have benefitted
