What is brownfield land?

‘Brownfield' is previously developed land. It's defined in Annex 2 of the National Planning Policy Framework as:

Land which has been lawfully developed and is or was occupied by a permanent structure and any fixed surface infrastructure associated with it, including the curtilage of the developed land (although it should not be assumed that the whole of the curtilage should be developed). It also includes land comprising large areas of fixed surface infrastructure such as large areas of hardstanding which have been lawfully developed. Previously developed land excludes:

  • land that is or was last occupied by agricultural or forestry buildings;
  • land that has been developed for minerals extraction or waste disposal by landfill, where provision for restoration has been made through development management procedures;
  • land in built-up areas such as residential gardens, parks, recreation grounds and allotments; and

land that was previously developed but where the remains of the permanent structure or fixed surface structure have blended into the landscape.

The register

The introduction of The Town and Country Planning (Brownfield Land Register) Regulations 2017 requires us to publish and maintain a register of brownfield land. This land must exceed 0.25ha (or be capable of supporting five dwellings) and be suitable, available and achievable for residential-led development (that is, self-contained dwellings).

The register will be structured in two parts. Part one will comprise sites which, based on best available information, are considered:

  • suitable
  • available
  • achievable

And in accordance with the guidance have regard to:

  • the development plan
  • national polices and advice
  • any guidance issues by the Secretary of State

Part two will be a subset of part one. It will be made up of the sites which we decide to grant permission in principle. Permission in principle, together with technical details consent, will form an implementable planning permission. We have not currently prepared a Part two register, although this position may change, dependent upon the Government’s planning reforms that are anticipated to come into force during 2025.

We're required to maintain the register. Therefore, there will be opportunities for further sites to be proposed for consideration.

Part 1 of our brownfield register

The Part 1 register was first published in 2017. Since then it has been regularly updated, the most recent update (December 2024) having been derived from the April 2024 housing trajectory. The dataset contains a list of previously developed (brownfield) sites with extant planning permission and/ or allocated in a development plan document (as of April 2024).

The data was submitted to the Government (Ministry of Housing, Communities and Local Government) in December 2024 and is provided under the Open Government Licence.

The site maps document (above) excludes site 18 (The Old Chapel, John Kennedy Road, King’s Lynn) which was considered for removal from the register but ultimately retained. Site 88 (Lynn Road, Stoke Ferry) of the register is entirely incorporated within site 7, so for site mapping purposes these are shown as a single site.
